TERMS & CONDITIONS OF SALE
By purchasing products from Tollgate Motor Spares, whether in-store, online, by telephone, WhatsApp or through any other sales channel, the customer agrees to the following Terms & Conditions.
1. Product Condition and Inspection
Unless expressly stated otherwise, products are sold based on the condition and description provided by Tollgate Motor Spares at the time of sale. Customers are encouraged to inspect products and confirm their suitability before purchase. Used, imported, second-hand or “X-Jap” parts are sold according to their stated condition and are subject to the applicable warranty terms.
2. Correct Application and Compatibility
The customer is responsible for providing accurate vehicle information, including the make, model, year, engine number/code, chassis number and part number where applicable. Tollgate Motor Spares will assist with identification and application where possible, but final confirmation of compatibility remains the customer's responsibility.
3. Engines and Gearboxes
Engines and gearboxes are sold subject to the specific conditions stated on the applicable Agreement of Sale/Warranty Card. Where an engine is sold with or without a gearbox, the exact items covered will be recorded at the time of purchase.
Unless specifically stated otherwise, the price of an engine does not include or cover the cost of the ECU/computer box, engine loom or engine wiring harness. This is consistent with the Company's engine warranty documentation.
3b. Engine Warranty
Where an engine warranty is provided, the warranty covers the specific defects stated on the applicable warranty card. Under the Company's standard engine warranty, these include:
- Engine knocking;
- Engine not turning; and
- Engine having insufficient compression.
The warranty does not automatically cover components or defects that are not specifically listed on the warranty documentation.
3c. Warranty Claims and Reporting Period
Any concern relating to an engine or gearbox must be reported to Tollgate Motor Spares before the engine or gearbox is removed from the vehicle and within 7 days from the date of purchase, unless a different period is expressly stated on the applicable warranty documentation.
Customers should not dismantle, open, modify or repair a product before contacting Tollgate Motor Spares regarding a warranty claim.
4. Installation and Fitting
Customers are responsible for ensuring that products are installed by a suitably qualified technician or mechanic.
Where applicable, engines and other mechanical components should be inspected, serviced and properly installed before use. Failure to follow appropriate installation procedures may affect the validity of a warranty claim.
5. Returns, Exchanges and Refunds
Returns, exchanges or refunds will only be considered where permitted under the applicable product terms, warranty conditions.
Products returned for consideration must be in the condition required by Tollgate Motor Spares and will be subject to inspection and verification before an exchange, repair or refund is approved.
A product that has been installed, dismantled, modified or damaged after purchase may not qualify for a return, exchange or warranty claim.
8. Deposits and Special Orders
Deposits paid toward special orders, imported products or products sourced specifically at the customer's request may be subject to the terms communicated at the time of order.
Customers should confirm the product specification, application and pricing before placing a special order. Tollgate Motor Spares reserves the right to require payment of a deposit before processing a special order.
9. Prices, Availability and Product Information
All prices, product descriptions, photographs, specifications and availability displayed on our website or other communication platforms are subject to change without prior notice.
While Tollgate Motor Spares endeavors to ensure that all information is accurate and up to date, occasional errors, omissions or changes in availability may occur. A product displayed as available online is not considered reserved or sold until the order has been confirmed by Tollgate Motor Spares.
10. Limitation of Liability
Tollgate Motor Spares will not be responsible for losses, labor costs, installation or removal charges, towing, transport, vehicle downtime or other consequential costs arising from the fitting, use or failure of a product, except to the extent that such liability cannot lawfully be excluded.
Tollgate Motor Spares reserves the right to inspect any product presented for a warranty, return or exchange claim before determining the appropriate remedy.
